ONLINE-ORDER OF MUSIL PRODUCTS

We Austrians are not too burocratic. But sometimes we need to have some rules, in order to prevent misunderstandings. You are invited to read carefully the general conditions of the contract. They are the basis for your satisfaction.



1. GENERAL CONDITIONS

You are obliged to read and respect the whole conditions of the contract. If you don't agree with these conditions, you must stop using this service of the MUSIL web-offer. We reserve the right to modify these rules whenever it may be necessary. Each change will be immediately placed on this site. Only corporate bodies and individuals with legal capacity, being of age, can use the Musil-shop.

2. YOUR CONTRACTING PARTY

As we do business all over the world, we divided our distributors geographically. Therefore the customs problems for you are minimized. All the companies are subject to our direct control and they have our quality guarantee and standards.

3. PLACE OF JURISDICATION (competent court)

Happy customers are our capital - this we mean worldwide. For the nearly impossible case of problems, we would like to fix the competent law and place of jurisdiction. The use of the UN contract on international trade, dated 11.04.1998 is excluded.

4. PRICE SYSTEM

4.A FOR ALL THE COUNTRIES OF THE EUROPEAN COMMUNITY

All the prices are Inclusive prices, inclusive all necessary taxes, FOB Klagenfurt - Austria. The prices include the packaging and handling fee. All the articles are packed in Cellophane. Special gift packaging only at the articles, where it is mentioned. For all orders for immediate delivery the rates of the day of the order apply. For orders with a later delivery date, the rates of the day of delivery apply. The final invoice is also showing the transportation costs. Import or custom clearance or customs costs have to be handled by the customer himself, and are not part of our responsibility or our invoice. We are not responsible for import licenses of the country of delivery.

4.B FOR THE US, CANADA AND THE CARRAIBEAN

For all other locations there is no sales tax. All the prices are Inclusive prices, inclusive all necessary taxes, FOB Klagenfurt Austria. The prices include the packaging and handling fee. All the articles are packed in Cellophane. Special gift packaging only at the articles, where it is mentioned. For all orders for immediate delivery the rates of the day of the order apply. For orders with a later delivery date, the rates of the day of delivery apply. The final invoice is also showing the transportation costs. Import or custom clearance or customs costs have to be handled by the customer himself (only outside USA), and are not part of our responsibility or our invoice. We are not responsible for import licenses of the country of delivery.

4.C FOR ALL OTHER COUNTRIES

For all the other order countries the rules of 4.1 or 4.2 are valid, related to the delivering company.


5. METHODS OF PAYMENT - REQUESTS FOR OFFERS

Generally we sell in the Internet only on the base of Credit card Payment. In the Shopping cart there is the possibility to pay on a prepaid base. In this case you will receive an invoice, including the freight rate. The production time starts on the day of receiving the money. Please understand, there are no deliveries, before the money is on our bank account.
Starting with an amount of EURO 600 (US DOLLAR 600) you have the possibility, to ask before for an offer. In case there are larger quantities of few articles, it might be possible, to offer special rates. We guarantee a 24-hour response time (weekdays).


6. SALES TO COMPANIES WITHIN THE EUROPEAN COMMUNITY

In the shopping cart we offer the possibility for companies to insert their UID (tax exempt) number. After the recheck of this number we can deliver to this companies without the 10 % VAT. In case we receive your payment earlier, we guarantee to pay the VAT back with a cheque within 48 hours of the recheck of the UID number. Please note, the recheck may take up to 6 days.


7. TIME OF VALIDITY OF THE SALES CONTRACT

All our offers are not binding. The contract between Musil and the customer is the consequence of a buyer order and a Musil acceptance. To transmit an order, the customer has to send a complete order-form, available on the Internet. Musil accepts the order sending the customer an e-mail with the confirmation of the order.


8. REVOCATION OF AN ORDER

The revocation of an order is possible only within 24 hours from the issue of the order itself, because the specific production of your order could be already begun. You cannot revoke the articles, which are already produced or sent.


9. RESERVE OF PROPERTY

The delivered goods remain in the property of the specific contracting party, till the payment of the whole amount by the customer has been effectuated.


10. DELIVERY TIME

All the ordered articles are fresh produced. All orders, arrving our shop between the 1st and the 15th of a month, will be delivered latest until the 31st of the same month. All articles orderen betweeen the 16th and the 31st of a month will be delivered until the 15th of the following month.  In the case we cannot respect the delivery time, you will be informed on the possible delivery time. In the case that the ordered goods would not be available, you will be informed in time. We reserve the right to rescind the contract and the right to not deliver the goods for reasons of lack of the goods themselves. In the case you have already paid for it, you will be repaid, without costs of any sorts.


11. WEIGHT INFORMATIONS

All the ordered articles are fresh produced by hand. As a consequence there might be a weight difference up to 10 %, in both sides. It is agreed, that less weight up to 10 %, or more weight - whatever - will not result in a change of the prices.


12. FREIGHT FORWARDER - AND BREAKAGE

INSIDE THE EC - we are using exclusively DHL. It is guaranteed a delivery time of 48 hours within the EC. At the moment the merchandise is handed to DHL, you will receive a delivery note via email with the freight number. So you can check yourself in the Web the way of your delivery. INSIDE US, CANADA or CARRAIBEAN we use UPS. Here you can choose the kind of the freight yourself.
In case of breakage give us a note within 24 hours after delivery. Only within this time we are able to check on the reason for the breakage.


13. QUALITY GUARANTEE

Our family and our experienced pastry chef's highest desire are, to deliver only highest quality in every respect. Perfect taste of chocolate means, that we only use the very best chocolate on the market. 3 Generations of highly awarded pastry makers guarantee, that we control permanently our quality standards. If you have a complaint, which comes from a production or quality mistake, we offer fast and customer minded solutions. In every box you will find a guarantee paper, with the date of production and the name of the pastry - chef. In case of any quality problem we ask to be informed immediately, because complaints are also a possibility to improve the quality or our organization.


14. REFUND POLICY

We are handling food articles. Law is not permitting the change of merchandise already left our house. We are sorry; not being able to guarantee you the exchange of already delivered chocolate articles.


15. CHOCOLATE SPECIALS

Chocolate consists of a high percentage of cacao butter. If chocolate gets too warm - and melts, the coca butter comes on the outside. This is no quality problem at all. The better the chocolate quality, the more the chocolate reacts on heat. Therefore please keep the chocolate cool and dry all the times. If chocolate is kept in normal room temperature, the quality remains for 6 month. The homemade truffles will keep only 5 weeks from the date of delivery.


16. PERSONALIZED ARTICLES FOR COMPANIES

We are the specialists in producing molds with your company logo or/and your main article. We would be more than happy, to be able to send some ideas and a principal offer to you. Due to the fact a special order, this General conditions are not valid, even if the first contact has been via this Web-shop.


17. DATA SECURITY

We are respecting very highly your privacy. All transferred information's are only used for our own purposes. We guarantee - that all your information will remain in our house, and there is no possibility, that we hand it out to somebody. Our computer system works on the highest possible standard.
If you are registering in this shop, or after an order we will use this information only to inform you on novellities. If you do not like to be informed on new chocolate products, just send an email: schokolade@musil.at with the remark: PLEASE NO MAIL.


18. COPYRIGHT OF THIS SHOP

This shop, the domains, the hosting space is exclusively owned by: Promo90 & Associati, Milano Italy. Our contract companies are allowed to use our services. All Photos, all pages are under copyright. It is forbidden to use anything from the content of this shop, unless agreed in a written form. In case of a misuse of this copyright, Musil is free to choose the place of Jurisdiction. It could be Milan, Italy  or Klagenfurt, Austria.


19. RESPONSIBILITY FOR THE INTERNET - AND SOFTWARE

In case of any technical problem we are not responsible, if the shop is out of order.


20. GENERAL FINAL RULE

In case a part of this general conditions is illegal, or is loosing its legality later, it is agreed, that the other chapters of this general conditions remain valid. On place of these unusable chapters, the general law will be used. The same is agreed, if there is no regulation for an unforeseen matter. The final validity is the German version of these guidelines.
